ACOFE CONSULTANTS (referred to as “ACOFE”) will source and provide contractors as requested by the Client. The services will be delivered in line with these Terms of Business and the verbal or written role requirements specified by the Client. All contractors supplied are appropriately qualified to deliver the required services.
The Contractor’s fee will be agreed upon before the commencement of each assignment or project. Fees may be calculated on an hourly basis or as a total project fee, as outlined in the agreed Project Proposal or Service Agreement.
Contractors will complete the hours necessary to fulfill the Client’s needs or to complete the assigned project within agreed timelines.
The Client must pay the Contractor Fees according to the agreed payment schedule.
Invoices will be issued weekly based on one of the following:
Verified hours worked by the contractor, supported by an approved timesheet. If a timesheet is not signed, the Client remains responsible for payment of the hours worked;
Completion of the contracted project; or
Any other invoice frequency agreed between ACOFE and the Client.
Invoices are payable strictly within five (5) days from the date of issue.
Any approved reimbursable expenses (e.g., travel, accommodation) will be itemized separately and charged to the Client at cost.
The Client assumes full responsibility for safeguarding its confidential information and intellectual property. ACOFE will not be held liable for any issues, claims, or disputes arising from the Client’s confidential material or intellectual property.
The Client must not share, transfer, or use any documentation produced by ACOFE for any organisation other than the one specified in the agreement.
All information shared with ACOFE for the purpose of service delivery will be treated as confidential. Likewise, any intellectual property or sensitive material belonging to either party must not be disclosed to third parties unless required by law. This obligation applies during the project and after any submission to relevant authorities. Confidential Information includes, but is not limited to, templates, forms, documents, and tools provided by ACOFE for compliance or project purposes.
ACOFE is committed to providing skilled and professional contractors to its Clients.
The Client agrees to indemnify and hold ACOFE harmless against any losses, damages, or expenses arising from the contractor’s actions, omissions, performance, or professional conduct during the engagement.
While ACOFE strives for positive outcomes, it does not guarantee approvals or results from any submissions or applications. Reasonable efforts will always be made to achieve successful outcomes.
ACOFE contractors or employees do not attend Administrative Appeals Tribunal (AAT) hearings or any judicial proceedings as expert witnesses on behalf of the Client.
By directly or indirectly engaging a contractor supplied by ACOFE, the Client is deemed to have accepted these Terms of Business.
No amendments to these terms are valid unless confirmed in writing by a Director of ACOFE CONSULTANTS.
